EMPLOYMENT LAW UPDATE: Bonus Entitlement Important in Wrongful Dismissal Litigation

The entitlement to bonuses has become an increasingly important issue in wrongful dismissal litigation, as the proportion of total executive compensation encompassed by such bonuses increases. In many compensation plans, the potential bonus makes up as much as fifty percent of overall compensation. It is not surprising therefore that the entitlement to such bonuses has been extensively litigated before the Ontario courts.

In a decision released on November 18, 2009, the Ontario Superior Court considered a claim for wrongful dismissal damages by an investment banker who worked for Scotia Capital.

Family Day is Celebrated on the 3rd Monday of February
Family Day is not a national statutory holiday, it is only observed in Alberta, Manitoba, Ontario and Saskatchewan, however, two other provinces have holidays in February: In PEI Islander Day (new since 2009) is celebrated on the 2nd Monday in February and in Manitoba the 3rd Monday in February is the Louis Riel Day holiday.

Increase in Minimum Wage – March 31st, 2010 - $10.25 per hour
The Ontario government will go ahead after all with a boost to the provincial minimum wage, says Premier Dalton McGuinty.

Employment Rate Unchanged in Ontario for December 2009
Following a large increase in November, employment was unchanged in December and the unemployment rate remained at 8.5%. In the last nine months, employment has stabilized but remains 323,000 (-1.9%) below the October 2008 peak.
